By using the Memofreeze platform, you agree to the following terms and conditions.
The following terms govern the use of the Memofreeze platform:
1.1. The platform is operated by Kevin Linne, Fröbelstr. 40, 35394 Gießen, Germany.
1.2. By using the platform and its services, users (hereinafter referred to as "Users") agree to the following terms and conditions.
1.3. The platform allows registered users to create digital guestbooks for events, which guests can access via a QR code. Guest contributions are stored and provided for the host.
2.1. Memofreeze offers the following features and upgrades:
2.2. Contributions (texts, photos, responses) are stored for the host and are accessible for a period of 3 years.
2.3. The platform is provided "as is." There is no guarantee of permanent availability or error-free use.
3.1. To create guestbooks, registration is required. Users must provide the following information:
3.1. The user is obligated to keep their login credentials confidential and not share them with third parties.
3.2. There is no entitlement to registration. The operator may reject registration requests without giving reasons.
4.1. Hosts are responsible for ensuring that no illegal or copyright-protected content is uploaded to the guestbook by guests.
4.2. The host must ensure that the consent of depicted individuals is obtained if guests upload photos.
4.3. In the event of legal violations, the host is liable and indemnifies the platform operator against all third-party claims.
5.1. Creating a guestbook in the free version is free of charge.
5.2. The following prices apply for paid upgrades (Plus and Giga):
Payment is processed via Stripe. The terms of use and privacy policy of Stripe apply (https://stripe.com/privacy).
Paid upgrades are one-time payments and non-refundable unless legal refund claims apply.
6.1. Guestbook entries are stored for a period of 3 years and then permanently deleted.
6.2. Users can cancel their registration at any time. This will result in the deletion of all data created by the user unless legal retention obligations apply.
7.1 Users are not allowed to use the platform to:

10.1. The operator reserves the right to amend the terms and conditions. Changes will be communicated to registered users at least 4 weeks in advance via email.

11.1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
